Terms & Conditions

The terms that govern access to and use of the RSA Property platform and its services.

1. Acceptance of these terms

By accessing or using RSA Property, creating an account, submitting an enquiry, publishing or managing content, or purchasing a service, you agree to these Terms & Conditions and any additional terms clearly presented for a specific service. If you act for an organisation, you confirm that you are authorised to act for that organisation.

2. RSA Property’s platform role

RSA Property is a technology platform for discovering, advertising and promoting property and property-related services, and for connecting users with agencies, agents, developers and other professionals. Unless expressly stated otherwise, RSA Property is not the seller, landlord, purchaser, tenant, estate agent, conveyancer, lender, insurer or other professional in a property transaction.

The party responsible for a listing or professional service remains responsible for its accuracy, legality, authority, disclosures and representations.

3. Accounts and eligibility

You must provide accurate and current information when creating or managing an account. You are responsible for maintaining the confidentiality of your credentials and for activity conducted through your account, except to the extent caused by RSA Property’s own breach or unlawful conduct.

Business and professional account holders may be required to provide information or documents reasonably required for verification, regulatory, billing, fraud-prevention or platform-integrity purposes.

4. Listings and user content

You may publish or supply content only if you have the authority to do so. Listing content must not be misleading, unlawful, discriminatory, infringing, fraudulent or materially inaccurate. You remain responsible for the underlying property information, images, pricing, availability and any required professional or regulatory disclosures.

By supplying content to RSA Property, you grant RSA Property a non-exclusive licence to host, reproduce, format, resize, index, distribute and display that content to the extent reasonably necessary to operate, market and syndicate the platform and the relevant listing or profile. You retain ownership of your content subject to that licence.

RSA Property may remove, correct the display of, suspend or refuse content where reasonably necessary for legal compliance, security, quality, duplication control, suspected fraud, rights complaints or enforcement of these terms.

5. Property enquiries and communications

When you submit an enquiry about a listing or professional service, you authorise RSA Property to transmit the information you provide to the relevant recipient and to process it as described in the Privacy Policy. RSA Property does not guarantee that a recipient will respond, that a property remains available, or that an enquiry will result in a transaction.

6. Packages, subscriptions and paid services

Prices, billing intervals, inclusions, limits, renewal terms and cancellation rules for paid services will be shown at or before purchase. Where a service renews automatically, the applicable renewal arrangement will be disclosed as part of the purchase flow. One-off promotional products, featured placement, advertising or add-ons may have separate validity periods or usage rules.

Fees already earned for a service period or product may be non-refundable except where required by law or where the specific service terms state otherwise. Payment processing may be provided by third-party payment providers whose own terms also apply.

7. Acceptable use

You may not use RSA Property to commit fraud, impersonate another person, scrape or harvest data in a manner that breaches law or technical restrictions, interfere with platform security, upload malware, bypass access controls, send unlawful unsolicited communications, publish content you have no right to use, or use the service in a way that materially harms RSA Property or other users.

Except where applicable law permits or RSA Property has expressly authorised it in writing, you may not systematically copy, extract, reproduce, republish, commercially exploit or redistribute substantial parts of RSA Property’s proprietary platform content, databases, software, layouts, workflows or documentation, or use protected RSA Property material to create a materially competing commercial product or service.

8. Intellectual property

Unless expressly stated otherwise, RSA Property owns or lawfully uses the intellectual property embodied in the RSA Property platform, including its original software, source code, platform architecture, user-interface elements, page layouts, workflows, databases and database structures, documentation, graphics, branding, logos, original written content, product names and proprietary platform functionality. These materials are protected by applicable intellectual-property and other laws.

Access to RSA Property does not transfer ownership or grant any licence beyond the limited right to use the relevant service in accordance with these terms and any applicable service agreement. No RSA Property branding, software, proprietary functionality or other protected material may be copied, licensed, sold, republished, commercially exploited or used to create derivative commercial products except where applicable law permits or RSA Property has expressly authorised it in writing.

Property photographs, descriptions, agency branding and other material supplied by users or third parties may remain owned by the relevant rights holder. Their appearance on RSA Property does not transfer ownership to another user.

9. Third-party services and links

RSA Property may integrate or link to mapping, payment, analytics, communications, social, advertising, syndication and other third-party services. Those services are controlled by their respective providers, and their separate terms and privacy practices may apply.

10. Information accuracy and platform availability

Property information can change quickly. RSA Property does not independently warrant every listing, measurement, price, image, property attribute, professional claim or availability status supplied by third parties. Users should verify material information directly with the responsible party before relying on it.

RSA Property may perform maintenance, upgrades, security work or service changes and does not guarantee uninterrupted availability at all times.

11. Liability

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited. Subject to applicable law, RSA Property is not liable for losses caused solely by inaccurate third-party listing content, the conduct of independent property professionals, a user’s failure to secure credentials, or third-party services outside RSA Property’s reasonable control.

12. Responsibility for claims arising from your content or conduct

To the extent permitted by law, a business or professional user is responsible for losses, claims or reasonable costs arising from content it supplied without authority, unlawful representations it made, or its material breach of these terms, except to the extent the loss was caused by RSA Property.

13. Suspension and termination

RSA Property may suspend or restrict access where reasonably necessary to protect the platform, users or third parties, investigate suspected fraud or abuse, comply with law, address overdue paid services where applicable, or enforce these terms. Where appropriate and lawful, reasonable notice or an opportunity to remedy may be provided.

14. Privacy

Personal information is processed in accordance with the Privacy Policy, Cookie Policy and applicable South African data-protection law.

15. Governing law

These terms are governed by the laws of the Republic of South Africa. Any dispute will be dealt with by a court or tribunal having lawful jurisdiction, subject to any mandatory consumer-protection or alternative-dispute-resolution rights that may apply.

16. Changes to these terms

RSA Property may update these terms to reflect changes in law, services, risk controls or platform functionality. Material changes will be published on this page and, where appropriate, communicated to affected account holders.
